Terms and Conditions

I. General Information

These general terms and conditions are issued by the company Sept.ch SA, P.O. Box 128, 1752 Villars-sur-Glâne.

Sept.ch SA is the publishing company of Sept mook and the websites sept.info and sept.club. Sept.ch SA also operates a Sept mobile application available on IOS and Android. These general terms and conditions apply exclusively to sept.info. sept.club is subject to its own general terms and conditions. The sept.info website is purely informative. The sept.club website is participatory and interactive in nature. The use of sept.info and the services offered by Sept.ch SA presumes knowledge and unconditional acceptance of the general terms and conditions below. Special conditions that contradict or diverge from these general terms of use have no value. In the event of a subscription concluded through an external provider, the general terms and conditions of the latter prevail, regarding the conclusion of the subscription, over these general terms and conditions. Sept.ch SA expressly reserves the right to modify at any time and without notice, all or part of these general terms and conditions. In the event of a modification of the general terms and conditions, the user will be invited to accept the new general terms and conditions under penalty of no longer being able to access the services of Sept.ch SA.

II. Use of the sept.info website

A. Terms Used

An "user" is any person who accesses the content and services of the sept.info website. An "subscriber" is any person who has a subscription to the Premium (digital and paper) or Digital version of the sept.info website and has a user account protected by a password on the sept.info website. A "single consumer" is any person who accesses an article on sept.info via the "pay what you want" platform of sept.info by creating a protected account with an access code using their email address and providing their credit card number.

B. Use of the Website

The use of the sept.info website is at the sole risk of the user, subscriber, or single consumer, with the published content being provided strictly for informational purposes.

C. Sept Account

The user guarantees that all data provided when creating their Sept account is accurate and complete. A user can only create one profile. The access parameters to their account, namely their username and password, are personal and confidential. The user is solely responsible for their use and agrees not to transfer or communicate them to a third party. Sept.ch SA assumes no responsibility in case of use by a third party of a user's access parameters. The user is required to immediately report any unauthorized use of their access parameters to sept.info.

D. Cookies

The user is informed that cookies may be stored on their computer's hard drive to record information related to their visits to the sept.info website. Cookies allow the user to be recognized, facilitate, and personalize the use of the sept.info website by remembering certain settings. They are used in particular to obtain information related to the pages viewed and the dates and times of consultation. The user can prevent the recording and storage of cookies on their computer by disabling the corresponding option in their browser software. However, some features of the sept.info website may require the use of cookies, without which the use of the site could be altered or even impossible.

E. Participation in sept.club

1. General Information

Sept.ch SA provides the public with a participatory space, the Club, at the address www.sept.club. The Club is subject to its own general terms and conditions.

2. Participation Charter

For the use of the Club of Sept.ch SA, reference is made to the Participation Charter and the general terms and conditions of the Club of Sept.ch SA available on the sept.club website.

III. Sale

A. Purpose

These general terms and conditions of sale govern the relationship between, on the one hand, Sept.ch SA and, on the other hand, the person who concludes a subscription with Sept.ch SA or a remote purchase through the sept.info website. Accepting an offer from Sept.ch SA implies full and unconditional acceptance of these general terms and conditions.

B. Types of Offers

1. Subscriptions

Sept.info and Sept mook offer two types of subscriptions: a Premium subscription, paper and digital, as well as a Digital subscription.

a. Premium Subscription

A Premium subscription means unlimited access to the sept.info website and receipt, at the address indicated when concluding the Premium subscription, of the paper version of Sept mook.

b. Digital Subscription

A Digital subscription means unlimited access to the sept.info website. The Digital subscription is individual. The client has a user account and personal access codes that allow them to identify themselves to personally use the subscribed services.

c. Subscription Duration

The subscription contract is concluded for the period indicated in the offer. Termination at the end of the subscription is done in writing to the following address: Sept.ch SA, P.O. Box 128, 1752 Villars-sur-Glâne. In case of early termination resulting in a refund, a fee of CHF 10.- is charged. Without written notice of termination given at least two weeks before the end of the subscription period, the subscription is automatically renewed for the same duration as it was initially concluded. In case of a change of residence within Switzerland, the subscription cannot be terminated but is transferred to the new address. The permanent departure abroad of a subscriber does not constitute a reason for terminating the contract, as the publication is delivered abroad for a period corresponding to the balance (in CHF) of the Swiss subscription. The contract can also be transferred to another beneficiary residing in Switzerland.

d. Validity Condition of the Subscription

When concluding the subscription, the user agrees to provide valid contact details. The subscription is personal and non-transferable. Sept.ch SA reserves the right to suspend or terminate the subscription without notice in case of abusive use. The subscription is only final after receipt and validation of the corresponding payment. In case of non-payment, Sept.ch SA may suspend or terminate the subscription without notice and is also entitled to claim the value of the delivered editions.

e. Replacement of the Subscription and Change of Publisher

If, for any reason, the publication should no longer appear during the subscription period, Sept.ch SA may offer the subscriber another service corresponding to the balance in francs of the subscription. In case of refusal of the offer, Sept.ch SA undertakes to refund the subscriber for the remaining subscription period. In case of a change of publisher, the subscription contract and the client file can be freely transferred.

2. Pay what you want

Sept.ch SA offers its users the possibility to access an article on sept.info via the "pay what you want" platform of sept.info. At the beginning of the article, the user must enter their credit card number. Once the article is read, the user has the option to determine the price of this article according to the value they deem fair. This value is within a range from 50 cents to infinity. Whatever the price paid, the concluded contract is a sales contract within the meaning of articles 184 ss CO. The total price includes the price of the product, all taxes included. The total amount of the price is determined solely by the consumer. Payment is made in cash through the payment methods offered at the time of price determination. In accordance with section V of these general terms and conditions, any purchase of an article through the "pay what you want" platform does not result in the transfer of intellectual property rights of which Sept.ch SA remains the exclusive owner. Each transaction made within the framework of the "pay what you want" operation is non-modifiable and non-refundable. The "pay what you want" offer is only available for articles available on the "pay what you want" platform of sept.info.

3. Online Store

Sept.ch SA offers an online store to its clients

a. Any successfully placed order is subject to an email confirmation of receipt of the order. However, this email does not prejudge the delivery time.

b. The buyer agrees to provide valid contact details at the time of the order.

c. Sept.ch SA reserves the right to refuse any order from a buyer with whom there is a payment dispute, without this constituting any compensation.

d. The products offered by Sept.ch SA are non-binding offers, which are only valid while stocks last.

e. The images accompanying the product descriptions are not part of the contract between Sept.ch SA and the buyer.

f. In case of unavailability of the ordered product, the buyer is informed. They then have the option to cancel their order or exchange the product. Sept.ch SA assumes no responsibility in case of damage due to a product no longer being deliverable, out of stock, or exhausted.

g. The client has a 7-day reflection period (postmark as proof), from the delivery date, to return, at their expense, in its original packaging, unopened, unused, or undamaged, the concerned article(s). To ensure the cancellation request is processed as quickly as possible, the client is asked to include the original invoice or a copy of it with the mention "order cancellation."

C. Price

Prices are offered in Swiss francs (CHF), including VAT at the applicable rate. The price at the time of the order is binding. Sept.ch SA reserves the right to change its prices at any time. Prices with the mention "subscribers" are granted only to people who have subscribed to a subscription with Sept.ch SA. The "subscribers" price only applies if the subscription is active at the time of the order. The indicated prices do not include shipping costs, which are charged additionally and vary depending on the number of suppliers, the weight, and the size of the package. Products remain the property of Sept.ch SA until full payment is received by Sept.ch SA. In case of non-payment of the order, for any reason, Sept.ch SA may demand the return of the products by right and without formality. Sept.ch SA reserves the right to refuse any order from a buyer with whom there is or has been a payment dispute, without this constituting any claim. Promotional offers are non-cumulative and reserved for non-subscribers or those who have not benefited from a special offer in the last two years at the same address in Switzerland.

D. Payment

Payment is made in cash through the payment methods offered at the time of acceptance of the offer, respectively its renewal. The currency used for transactions is the Swiss franc (CHF). Credit card payments are made through the SSL secure system, without additional fees. The online payment phase takes place in a secure space, and all exchanges are encrypted.

E. Delivery

1. Upon confirmation of the order, Sept.ch SA undertakes to communicate the "login" access codes and to process and ship the ordered products to the delivery address indicated as soon as possible. Products are delivered to the address indicated at the time of the order. Sept.ch SA cannot be held responsible in case of delivery return due to an address error or inability to deliver to the indicated address. If the delivery return or inability to deliver is due to a lack of information or an address error, the costs of a new delivery will be fully charged to the client.

2. Sept.ch SA undertakes to inform the client in case of a foreseeable delay in delivery or sending of the codes. A delivery delay never leads to a reduction in the sale price. Any liability is also excluded in case of damage resulting from a delivery delay. Sept.ch SA declines any responsibility in case of poor delivery abroad.

3. Changes to the delivery address must be announced in writing to the subscription service or by email to the address: [email protected] at least five working days in advance. Temporary address changes are not allowed for a period of less than one week.

4. In case of distribution abroad, distribution costs are borne by the subscriber and will be added to their next invoice. In case of unjustified refusal to receive ordered and delivered items, the resulting costs will be charged. In case of repeated refusal to receive, Sept.ch SA reserves the right to terminate the subscription without this constituting any claim.

5. Paid content on the sept.info website is accessible upon registration and payment by the client and after receipt by Sept.ch SA of the receipt from banking institutions.

F. Responsibility of Sept.ch SA

Despite the care given to the content it publishes, Sept.ch SA assumes no responsibility for the fidelity, accuracy, timeliness, reliability, and completeness of the information on its website. Sept.ch SA provides no guarantee regarding the actual identity of users, respectively subscribers, or single consumers. Sept.ch SA cannot be held responsible for any direct or indirect damage, of any kind, resulting from the use or inability to use its website freely or by subscription. Sept.ch SA cannot be held responsible in case of total or partial hacking of the site and any damage caused to the user or a third party by such hacking. Sept.ch SA declines any responsibility for hyperlinks present on the sept.info website if they refer to external sites that violate current legal and regulatory obligations. The user, respectively the subscriber, is responsible to Sept.ch SA for any damage of any kind caused during the use of the Sept.ch SA website. Sept.ch SA undertakes to regularly upload content but assumes no responsibility for force majeure cases. Temporary unavailability of electronic content does not give rise to any compensation. In case of prolonged unavailability attributable to the publisher, the subscriber who requests it may be granted, depending on the specific case, an extension of their subscription. Photographs and texts reproduced on the site and illustrating the products and/or services presented are not contractual. Sept.ch SA's liability cannot be engaged if differences are found.

V. Data Protection

When Sept.ch SA collects personal data from users, it strictly complies with the provisions of the Constitution and data protection legislation. Users' personal data is treated confidentially. Users' email addresses may be used by Sept.ch SA as a means of communication regarding concluded subscriptions as well as to inform users about the evolution of its services or commercial offers. They may be transmitted with the express consent of the user or when their transmission is necessary for the identification, questioning, or legal prosecution of any person infringing on the interests of Sept.ch SA or any other person. Personal data may also be provided to third parties in the context of games or contests organized by Sept.ch SA and potential partners of Sept.ch SA when necessary to identify and deliver prizes, namely the names, first names, and addresses of users. The user has the right to consult the personal data concerning them in possession of Sept.ch SA upon simple request to the address [email protected]. They can have it modified, corrected in case of error, or deleted.

VI. Intellectual Property

A. General Information

Sept.ch SA is the exclusive owner of all intellectual property rights both on the structure and the content of the website, whether it is freely accessible or accessible by subscription or through the "pay what you want" platform. Any content published on the sept.info website, regardless of its nature (text, illustration, photograph, brand, logo, graphic charter, etc.) or its origin, whether it is a contribution from a collaborator or that of a subscriber, is protected by intellectual property rights. Therefore, any reproduction, adaptation, modification, translation, transformation, distribution, reuse, integration on another medium, exploitation in any way, of the content of the sept.info website is imperatively subject to the prior written authorization of Sept.ch SA or the rights holder. Any unauthorized use of content on the sept.info website may result in civil or criminal legal proceedings.

B. Information on Facebook, Twitter, and LinkedIn Links

The sept.club website allows its users, through the "Share" buttons of Facebook or LinkedIn or the "twitter" button, to recommend an article published on the sept.info website to their Facebook friends, on their Twitter profile, and on LinkedIn. Once the button is pressed, a new window opens, requiring a connection to Facebook, Twitter, or LinkedIn. A Cookie will be placed on the computer. The number of users having access to the publication recommending the article depends on the Facebook, Twitter, or LinkedIn settings of each individual user. Cookies from Facebook, Twitter, or LinkedIn are placed on the sept.club website. The connected user of Facebook, Twitter, or LinkedIn agrees that information is transmitted to their Facebook, Twitter, or LinkedIn profile. For the regulation of Cookies and the information collected by this means, reference is made to the general terms and conditions of Facebook, Twitter, or LinkedIn. The user is deemed to accept any information transfer by this means. Sept.ch SA assumes no responsibility regarding the transfer of information by Cookies placed by these social networks.

VII. Participation in Contests

Participation in games and contests of all kinds on the sept.info website is free, but in all cases limited to registered users. Multiple participation is excluded. The names of the winners and their photos may be published on the various media of Sept.ch SA. No correspondence is exchanged on the games, and the legal recourse is excluded. No prize is exchangeable or convertible into cash. The specific conditions of each game, contest are included in the participation conditions as well as in the respective regulations for each game.

VII. Applicable Law and Jurisdiction

Swiss law applies to these general terms and conditions. The courts of the company's headquarters, Sept.ch SA, have exclusive jurisdiction in case of dispute.
